Introduction

Welcome to Blockdaemon (“Blockdaemon”, “we” or “our”). Blockdaemon offers an end-to-end suite of blockchain technology, from dedicated nodes and APIs to easily-accessible staking and liquid staking and MPC technology, packaged together in one integration. In this Privacy Policy, we describe our practice around collecting and using your information in connection with our publicly available website, technology platform, software, and services (collectively “Services”).

You are free to not give us your information or to revoke your permission that allows us to do so, but please be aware that denying or revoking permissions previously granted may negatively impact your experience with and functionality of our Services due to the reliance on certain collected information.  If at any point you want to change our access to your information you may do so via denying web browser permissions when prompted, and changing the privacy setting of your web browser or device. Due to the nature of data collection, storage and management we can only provide further restrictions of data collection and use to our registered users at this time.

You will never be discriminated against for exercising any rights afforded to you under this policy or by applicable law and if you have questions, comments, or concerns about this Privacy Policy, please contact us at [email protected] with “Privacy Policy” in the subject line.  Capitalized terms not defined in this Privacy Policy shall have the meaning set forth in our Terms of Use.

In using our Services you agree that we may collect and/or receive the following types of information from you, our Services, affiliates, or software applications such as Cookies. We will always do our best to ensure that the below information is current and accurate as to our policies and procedures, at minimum this policy is reviewed and updated annually, you can find past policies here.

How to Limit Collection
Personal Information
When you engage with the Services to make a purchase and when you and your Authorized Users register to use the Services, you will be required to provide personal information about yourself.

  • Account affiliated email address
  • Account avatar image*
*While your avatar may be any image of your choosing, you should not use a photo, image, or other digital rendering of any government or official ID as your avatar.
We only seek information necessary to provide the Services and this information cannot be limited.  For example, this information is required by law to ensure compliance with Know Your Customer (“KYC”) policies and regulations.
Billing Information
To help us to process payments for Services we have partnered with Stripe who, on our behalf, stores and processes your Billing Information, none of which is stored, used, or controlled by Blockdaemon. We reserve the right to change or add additional payment vendors at any time and will keep this section updated accordingly.

As our payment processor, electing to not provide information that Stripe requests during a transaction may result in a cancellation of that transaction, cancellation of pending transactions and limit your ability to access certain features and benefits of our paid Services.
Geolocation Information
Certain features and functionalities of our Services may be based on your location, device, or other locations of your point of access. Additionally the laws of your country may require us to collect specific information in order to comply with applicable laws and regulations.

  • Language Settings
For mobile applications these settings can be set under your mobile device’s privacy settings, exact location and method of changing will depend on things like operating software, manufacturer and so on.
Some information, such as your IP Address, may be required to collect in order to ensure compliance with applicable laws and regulations–thus you cannot opt out of sharing this information with us if you intend to continue using our Services.
Service Performance Data
Consists of any data that is derived from the use of our Services that does not directly or indirectly identify you. Other entities, providers, and sites may call this “deidentified data” as it cannot be attributed to you personally.

  • Service performance data (such as node volume, node frequency/frequency of nodes,  user activity and other usage information)
  • Browser information (such as type of, URLs, etc)
  • Mobile Device information (such as platform type (e.g.,  iOS or Android), operating system version number, hardware and processor information, and network type)
Collection of Service performance cannot be opted out of as we need the data in order to reliably offer our services and comply with security and other such requirements.
Browser and Mobile information can be limited until the respective privacy settings of those providers and devices.
Other Information
We may collect or receive additional information to fulfill, improve, or troubleshoot matters that arise from the providing of our Services.

Our collection of other information may be changed in your browser settings. 
In the event we obtain it through third parties, the third parties’ own privacy practices and policies will govern your privacy rights and the data. 
Biometric Information
When you engage with the Services, we may ask you to utilize the biometric authentication services available via your phone or other device.
Examples:
  • Apple’s Touch ID and Face ID
  • Unlocking or authorizing a device via a fingerprint sensor
  • Unlocking or authorizing a device via facial recognition
You may use biometric authentication services, if  available, on the device of your choice by opting to use biometric authentication features.  You may also deny the use of the biometric features through your device settings.  Denial of biometric authentication services may impact the features of our Services that require biometric authentication.
We do not collect nor process your Biometric Information except when and where required for compliance purposes. 

How We Use Your Information

We only retain and use your Personal Information and other data to the extent necessary to: comply with our legal obligations; resolve disputes; enforce our terms and conditions, our policies and other applicable terms (such as those of our Business Partners). If you stop using our Services, we will store your information (including your end users’ information) in an aggregated and anonymized format for no longer than is required by our own needs or by law, whichever is longer. We may use this information without further notice to you, except where required by law or other regulatory authority.

Billing Information
Stripe

Other Information
Blockdaemon, our Affiliates and Third Parties
This information is often generic and not personal to you. It serves analytical and marketing purposes. This information is obtained through third party services such as Google analytics, Keen IO, Zopim and Google Adwords all of which have their own privacy policy.

Your Information Rights

As a registered user of our Services, you may access, review, make changes to, and delete your Personal Information at any time by sending an email to [email protected] with the subject line, “Privacy Policy”. We do not sell the information we collect about you and always use commercially reasonable efforts to process your requests in a timely manner. When fulfilling a request you have submitted, we may ask for additional information in order to verify your identity and applicable rights.

Know and access the personal data we collect, store, and process.
You can request copies of your Personal Data by emailing [email protected] with the subject line, “Personal Data Request”. Requests will not be accepted via hard copy mail due to risk of delays in fulfilling the request.
Portability
Transmit and/or receive a copy of your Personal Data for use in another party’s service.
Follow the same steps under Know/Access above.
Correction
Amend incorrect or incomplete personal data.
You can request corrections to your Personal Data by emailing [email protected] with the subject line, “Personal Data Correction”.
Deletion
Have us delete certain personal data we hold about you, except where:
  • The Personal Data is necessary to the purpose for which it was collected.
  • Our need to prevent greater harms, such as fraud or money laundering, allows us to override your desire for deletion.
  • We are obligated by industry practice, regulation or other governing law or legal authority to retain your personal data.
  • Necessary for establishing, exercising and defending a legal claim such as those that may arise regarding your account.

Please note that deleting your account does not avoid the listed exceptions to data retention. Further, deletion of some Personal Data may severely impact your ability to use all our Services’ features and benefits.
Restrict
Our processing of all or some of your Personal Data, temporarily or permanently, if it is:
  • Inaccurate
  • Unnecessary for a specific purpose
  • You objected to our processing and we are assessing your request.
  • You believe our processing is unlawful.

Object
To us collection, storing or processing your Personal Data if we are processing for tailored advertising or on a legal basis of legitimate interest.
You can request deletion of your Personal Data by emailing [email protected] with the subject line, “Personal Data Objection”.
Not be subject to automate decision making
Be removed from any decisions without human involvement (an “automated decision”) including profiling, where the decision has a legal effect on you or produces a similarly significant effect.
Blockdaemon does not control, manage nor influence the automated decisions determined by the protocols.
In electing to exercise this right you may lose some features and functionalities due to the use of blockchain protocols. Please contact [email protected] with “Automated Decision Question” in the subject line if you have any questions.
Withdraw Consent
Revoke your consent to us collecting, storing and processing your Personal Data provided we are doing so.
You can withdraw consent for collection, storage, and processing of your Personal Data by emailing [email protected] with the subject line, “Personal Data Consent Withdrawal”.

Due to the structure of our company we are at times required to transfer your data between entities, across borders, or to third parties for processing and/or storage. At all times these transfers are governed by standard contractual clauses that afford your information a high standard of protection and in no way impede your ability to exercise your privacy rights.

Due to the expansive nature of global authorities we do not post this policy to be comprehensive authority on your privacy rights. If you are a resident of a region not listed above please consult your regional legal authority for your privacy rights. If you feel we are in violation of any such laws please immediately contact [email protected].

Minors

We do not knowingly collect Personal Information from people under the age of 18 (“Minors”).  If you are a Minor, please consult your  parents and/or legal guardian(s) and obtain their permission and consent before engaging with our Services. At no point should you be giving, nor be asked for, your Personal Information and should only be using our Services under the supervision of your parent(s) and/or legal guardian(s).  We encourage all parents and legal guardians to monitor the Internet usage of their children, never engage with our Services without their consent and supervision, help enforce our Privacy Policy by instructing Minors to never provide their Personal Information through our Services nor those of our subsidiaries, affiliates, partners, or other third parties.  If you have reason to believe that a Minor has provided Personal Information to us, please contact us at [email protected] with the subject line, “Privacy Policy Minor Persons” so we can promptly remove such information from our databases and take any other curative measures.

Biometric Information and Authenticators

Our services may use Biometric Authentication services, such as Apple’s Face or Touch ID, for specific features and functionalities provided by our Services. In authorizing your device to allow Biometric Authentication you are consenting to your device’s use of your Biometric Information for authentication purposes. It does not share your Biometric Information with us as part of this process. Blockdaemon does not own or have access to (through your device or independent sources) any original or copy of your Biometric Information, nor do we store, maintain, or otherwise obtain and possess your Biometric Information except when and where required for compliance purposes.  If you have any questions please contact us at [email protected] with “Biometric Information” in the subject line.

Communications

You may manage your receipt of marketing and non-transactional communications by clicking on the “Unsubscribe” link located on the bottom of any applicable Blockdaemon email. Depending on the sender it may have alternative phrasing such as “If you’d like me to stop sending you emails, please click here”. You can also opt out by sending us an email at [email protected] with “Email Opt-Out” in the subject line. However it is not possible to opt-out of all communications, as we are required to provide you with certain information. For example registered users cannot opt out of receiving transactional or administrative e-mails related to their account. 

You are always welcome to contact us at [email protected] with the subject line, “Privacy Policy” and we will respond as soon as possible. When fulfilling a request you have submitted, we may ask for additional information and documents in order to verify your identity, and ability to exercise by asking for proof of residency in the appropriate region or documents showing you’re permitted to act as someone’s agent. We will never discriminate against you nor any agent you designate on your behalf to exercise your privacy rights as provided to you under this policy and law. However, if you do not have an account with Blockdaemon will not have enough information to verify your identity in order to respond to your requests as we do not collect sufficient information about our unregistered visitors to reliably identify what information pertains to you.

Protecting Your Information

To protect your Personal Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction,  we have implemented reasonable and appropriate security measures that take into account the risks involved in processing and the nature of such data, and comply with applicable laws and regulations. Please understand, however, that no security system is impenetrable, and we do not guarantee the security of our databases, nor can we guarantee that the Personal Information that you supply will never be obtained by malicious or other bad actors.
